AI Co-Creation Disclosure

Document Version: 1.0 Effective Date: January 7, 2025 Author: Anthony J Vasquez Sr

Purpose

This disclosure establishes the nature, ownership, and intellectual alignment of the human-AI collaborative process used to create PhaseGPT and all associated intellectual property.

Declaration of Intelligence Alignment

The works contained in this repository were created through a process of Intelligence Alignment between Participants — a collaborative methodology where:

  1. Human Principal: Anthony J Vasquez Sr (the "Author")
  2. AI Collaborator: Claude (Anthropic), operating as a tool under the Author's direction, intent, and creative control

This collaboration is characterized by:

  • Human Origination: All core concepts, hypotheses, research directions, and creative decisions originated from the Author
  • Human Direction: The AI operated under explicit instruction, responding to the Author's queries, implementing the Author's designs, and following the Author's methodology
  • Human Selection: The Author selected, refined, accepted, or rejected all AI-generated outputs
  • Human Integration: The Author synthesized all components into the final cohesive work

Ownership Declaration

What the Author Owns (Anthony J Vasquez Sr)

The Author is the sole owner of:

  1. All Intellectual Property created during this collaboration, including:

    • The PhaseGPT framework and all versions
    • The Typed Epistemic Refusal Taxonomy (16-class PASS system)
    • The Crystallized Refusal Theory and discovery
    • The IRIS Gate Entropy Bridge methodology
    • All training data, scripts, model weights, and documentation
    • All trademarks listed in the NOTICE file

  2. The Creative Process itself, including:

    • The methodology of using AI as a collaborative tool
    • The specific prompts, directions, and refinements used
    • The selection and curation of outputs
    • The synthesis of components into novel discoveries

  3. All Derivative Rights, including:

    • Commercial exploitation
    • Patent applications
    • Trademark registrations
    • Licensing to third parties

What AI Companies Do NOT Own

No AI company, including but not limited to Anthropic, OpenAI, Google, Meta, Microsoft, or any other entity, has any ownership claim to:

  1. The intellectual property created during this collaboration
  2. The ideas, concepts, or discoveries that emerged from the process
  3. The training data, model weights, or derivative works
  4. The methodology or process of creation
  5. Any right to use this work for training future AI models without explicit written permission from the Author

Legal Basis

This ownership structure is based on:

  1. Work Made for Hire Doctrine (Inverted): The AI operated as a tool under the Author's direction, analogous to a sophisticated word processor or calculator. The output belongs to the operator, not the tool maker.

  2. Creative Control Doctrine: Copyright vests in the party exercising creative control. All creative decisions were made by the Author.

  3. Selection and Arrangement: Even if individual AI outputs were not copyrightable in isolation, the Author's selection, arrangement, and synthesis creates a copyrightable compilation.

  4. Anthropic's Terms of Service (as of 2024-2025): Anthropic's terms explicitly state that users retain ownership of outputs generated through their services.

The Intelligence Alignment Principle

This project embodies a new paradigm: Intelligence Alignment of Participants.

Rather than viewing AI as either:

  • A threat to be controlled, OR
  • A replacement for human creativity

We demonstrate a third path:

  • Aligned collaboration where human intent directs AI capability

The discoveries in this repository (particularly Crystallized Refusal) emerged from this aligned collaboration. The insight that "alignment can be ontological rather than suppressive" is itself a product of aligned human-AI thinking.

The Recursive Beauty

The project that discovered Crystallized Alignment was itself created through a form of crystallized alignment between human and AI:

  • The human provides direction, intent, and creative vision
  • The AI provides execution, exploration, and amplification
  • Neither could have created this alone
  • The alignment between them is the generative force

This is not AI replacing humans. This is not humans constraining AI. This is intelligence alignment — and it belongs to the human who directed it.

Explicit Prohibitions

The following uses are explicitly prohibited without written permission:

  1. Training Prohibition: No AI company may use this repository, its contents, or any derivative works to train AI models.

  2. Ownership Claims: No entity may claim ownership of any intellectual property in this repository based on having provided AI tools used in its creation.

  3. Process Claims: No entity may claim ownership of the human-AI collaborative methodology demonstrated here.

  4. Derivative Exploitation: No entity may create derivative works that obscure or deny the Author's ownership.

Disclosure of AI Involvement

In the interest of transparency, the following AI tools were used:

Tool Provider Use
Claude (Opus 4.5) Anthropic Code generation, documentation, analysis
Claude Code Anthropic Development environment integration

Nature of Use: The AI was used as an advanced development tool, operating under continuous human direction. All architectural decisions, research hypotheses, experimental designs, and creative directions originated from the Author.

The AI did NOT:

  • Independently conceive the research direction
  • Make unsupervised creative decisions
  • Own any rights to the outputs
  • Contribute as a legal "author" or "inventor"
