DMs are always created as encrypted even when the other device doesn't support encryption #24995

Steps to reproduce

  1. Send a DM to @enctest03302023:t2l.io (this user has no encryption-capable devices)
  2. Note that the room is encrypted

Outcome

What did you expect?

An unencrypted DM, like Element Android and iOS do (and I thought we did up until this issue :p )

What happened instead?

The DM was encrypted
